49-Year-Old Man Charged with Document Crime in Varna.
A 49-year-old man has been charged with a document-related offence in Varna over geodetic surveys used to issue certificates of building tolerance.
The surveys allegedly led to false circumstances being entered into an official document, which was used to issue certificates of tolerance for constructions, including in the Baba Alino area. This was reported by the press office of the Varna District Court.
The court found that, based on the evidence collected at this stage of the pre-trial proceedings, a reasonable assumption could be made regarding the authorship of the act. Given the available information about the defendant’s registered address, clean criminal record and lack of previous criminal conduct, the real risk that he may abscond or obstruct the investigation is not elevated.
The court also took into account that the offence for which the 49-year-old man has been charged falls under Article 314 of the Criminal Code, which provides for a penalty of up to two years’ imprisonment or probation. In this specific case, given the absence of prior convictions, if he is found guilty, this would imply release from criminal liability and the imposition of an administrative fine.
The ruling on the measure may be appealed within three days. In the event of an appeal or protest, the case is scheduled to be heard by the higher court, the Varna District Court, on July 3 at 11:00 a. m.
