Supreme Court of Cassation Confirms: Complex Horizon in Varna Owes Nearly 380 Thousand Leva for Illegal Use of State Properties.

This became clear from a decision by the Supreme Court of Cassation (SCC), which refused to review the appeal filed by the company Oversize-Horizont AD.

According to the ruling, the company used two properties in the Saltanat area with a combined area of around 3,500 square meters. The plots are state-owned and were provided for management to the Municipality of Varna. Part of the land contained temporary structures and commercial facilities, pergolas, a shelter and gazebos.

In addition to paying the amount owed, Oversize-Horizont must also vacate and hand over the parts of the land that were used beyond the permitted areas.

The Supreme Court judges upheld the decision of the Varna Court of Appeal, according to which the company had used the two properties in the Saltanat area between August 2018 and 2022. During that period, temporary structures and commercial facilities, pergolas, a shelter and gazebos were located on parts of the properties.

The SCC ruling is final and cannot be appealed.

During the court proceedings, a witness also stated that access to the complex required visitors to be customers of the establishment and that not everyone could freely use the area.

The witness said that security guards and employees of Horizont, dressed in black and wearing earpieces, frequently came to the complex. According to her, they stood at the bar under the canopy and told visitors that they had to pay an entrance fee or leave the premises. She said they asked people where they had entered from and charged them an access fee.
